Saf-T-Pak Training Service Terms

Effective date: [INSERT DATE]
Version: [INSERT VERSION]

1. Introduction and scope

These Training Service Terms (“Training Terms”) govern the purchase, assignment, access, and use of Saf-T-Pak online training courses, assessments, digital training documents, completion certificates, and related training administration services.

These services are provided by Saf-T-Pak Inc., a company incorporated in Canada, operating under the Inmark Life Science customer-facing name (“Saf-T-Pak,” “we,” “us,” or “our”).

These Training Terms apply to:

  • Individuals purchasing training for themselves.
  • Organizations purchasing training for employees or other authorized learners.
  • Individuals administering training through the Course Administration Hub.
  • Learners accessing courses or digital documents through product keys, assignments, or other authorized entitlements.

These Training Terms supplement the Inmark Life Science Application Terms of Use (“Application Terms”).

2. Definitions

In these Training Terms:

  • “Purchaser” means an individual or Organization purchasing training or digital documents.
  • “Learner” means the individual assigned to or completing a course.
  • “Training Administrator” means an individual authorized to administer training through the Course Administration Hub.
  • “Training Materials” means course content, assessments, reference materials, digital documents, and other learning resources supplied by Saf-T-Pak.
  • “Product Key” means a key providing access to a specified course or digital document.
  • “Administrator Key” means a key providing access to the applicable training administration features.
  • “Access Period” means the period during which a Product Key permits access to its associated Training Materials.
  • “Course Description” means the information identifying a course’s scope, intended audience, applicable regulatory framework, edition or version, and other material conditions.
  • “Organization” means a business or other entity purchasing, assigning, or administering training.

3. Relationship to other agreements and policies

These Training Terms govern training-specific matters. The Application Terms govern general account access, security, acceptable use, Organization permissions, and other shared application matters.

If these Training Terms conflict with the Application Terms, these Training Terms control for the training-specific subject involved.

A separate customer-specific agreement with the relevant Inmark entity takes priority to the extent it conflicts with these Training Terms on the same subject.

Purchases through an online store are also subject to the applicable purchasing terms. These Training Terms govern training-specific access, assignment, exchange, and refund matters, subject to any customer-specific agreement and applicable law.

Personal information is handled as described in the Saf-T-Pak application privacy notice:

https://shop.saftpak.inmarklifescience.com/policies/Application-Privacy-Policy

[BEFORE PUBLICATION: Confirm the privacy notice is published and align the storefront refund policy with Section 14.]

4. Eligibility and registration

All Learners and Purchasers must be at least 18 years old, including Learners invited by an employer or Training Administrator.

An individual may purchase and complete training without being associated with an Organization or Training Administrator.

Creating a free account does not provide access to paid courses or digital documents.

Each Learner must use their own account and provide accurate identifying information. A Learner must not complete training or assessments through another person’s account.

Individuals purchasing or administering training for an Organization must have authority to perform those activities on its behalf.

5. Purchases and course selection

Product Keys may be purchased through the Saf-T-Pak online store or through purchasing features in the Application connected to that store.

Before purchasing, the Purchaser is responsible for reviewing:

  • The course subject and intended audience.
  • The applicable jurisdiction, transport mode, and regulatory framework.
  • The course edition or version.
  • Any prerequisites.
  • The language of instruction.
  • The number of Product Keys required.
  • The Access Period.
  • Applicable exchange and refund conditions.

Purchasing training does not provide rights beyond the products and quantities identified in the order.

An Administrator Key does not, by itself, provide additional course entitlements or unlimited Learner access.

Pricing, taxes, payment arrangements, and order acceptance are governed by the applicable purchasing terms or customer agreement.

6. Product Key Validity and Access Period

6.1 Standard Access Period

Unless a different period is clearly disclosed in the product details at the time of purchase, a Product Key is valid for 365 days from the date of purchase.

The Access Period begins immediately upon purchase, whether or not the Product Key has been assigned, activated, or used.

Delaying assignment, registration, activation, or training does not delay the start of the Access Period.

6.2 Product-specific periods

If a course or digital document has an Access Period other than 365 days, that period will be identified in its product details and clearly shown at the time of purchase.

6.3 Administrator Keys

Administrator Keys do not currently have a fixed expiry date.

An Administrator Key does not extend the validity of the Product Keys it administers. Each associated Product Key remains subject to its own expiry date.

Administrator access remains subject to the Application Terms and any applicable customer agreement.

6.4 Access after course completion

A Learner who completes a course may continue reviewing its content during the remaining Access Period.

Once the Product Key expires, the Learner may no longer use that key to:

  • View the course content.
  • Take or retake assessments.
  • Complete additional topics.
  • Update assessment results.

Available historical records and certificate-reprinting functions may remain accessible as described in Section 13.

6.5 Access expiry and certificate expiry are different

A Product Key’s expiry date governs access to the purchased product. A training certificate’s expiry date governs the period recorded for that certificate.

These dates are separate and need not be the same.

Retaking an assessment using the same Product Key after the first valid certificate has been achieved does not extend the training certificate’s expiry date.

7. Assignment, reassignment, and administrator transfers

7.1 Unused Product Keys

Unused Product Keys may be transferred to another eligible Learner.

A transfer does not restart or extend the Access Period.

7.2 Assigned Product Keys without progress

An assigned Product Key may be released and reassigned only if the Learner has not completed any course chapters or exams and no course progress has been recorded against that key.

Once course progress has been recorded, the Product Key may no longer be reassigned to another Learner.

A Learner’s name or account details must not be changed to circumvent this restriction.

7.3 Administrator Key transfers

An existing Training Administrator may transfer Administrator Keys to a new administrator through the supported Course Administration Hub process.

If the original administrator is no longer employed by the Organization, an employee authorized to act for the Organization may request that the Administrator Keys be released to an unassigned state.

The request must:

  • Be provided on official Organization letterhead.
  • Identify the Organization and relevant administrator account.
  • Explain the requested change.
  • Identify the requesting employee and their authority.

For security purposes, the Organization must also retain access to the original keys, records, or other verification assets required by Saf-T-Pak to complete the transfer.

A letterhead request alone does not guarantee that a transfer can be completed. Saf-T-Pak may require additional verification.

8. License to use Training Materials

Subject to payment and these Training Terms, Saf-T-Pak grants the authorized Learner a limited, nonexclusive, nontransferable right to use the purchased Training Materials for their intended training purpose during the Access Period.

The reassignment permitted under Section 7 does not permit simultaneous or shared use of one Product Key by multiple Learners.

Authorized Training Administrators may use administrative features and materials to manage the training they are entitled to administer.

Unless expressly authorized, you must not:

  • Share course access with another person.
  • Reproduce, record, publish, or redistribute course content.
  • Share restricted assessment questions or answers.
  • Sell or sublicense Training Materials.
  • Use the materials to provide a separate training service to others.
  • Remove copyright or ownership notices.

Materials expressly made available for download may be used within the permissions accompanying them.

Learners and authorized administrators may retain legitimate completion records and certificates for training, employment, audit, and compliance purposes.

9. Course scope and suitability

Courses address the subjects, jurisdictions, transport modes, and regulatory versions identified in their Course Descriptions.

Global availability of the Application does not mean that every course satisfies every jurisdiction’s requirements or is appropriate for every job function.

The Purchaser and, where applicable, the employer are responsible for selecting training appropriate to the Learner’s duties.

Unless expressly included, a course should not be understood to cover every:

  • Dangerous-goods category.
  • Transport mode or jurisdiction.
  • Carrier requirement.
  • Workplace procedure.
  • Practical task or competency evaluation.
  • Employer-specific operating requirement.

Contact Saf-T-Pak before purchasing if the suitability of a course is unclear.

Nothing in this section reduces an express commitment Saf-T-Pak makes about a course’s content or coverage.

10. Assessments and training integrity

10.1 Completion requirements

Learners must personally complete the course requirements and assessments.

The required passing score is established for each course. The standard passing score for most courses is 80%, but the score shown on the assessment summary screen before entering the exam controls for that assessment.

Certificates are generated only after all applicable course prerequisites and completion requirements have been satisfied.

10.2 Reference materials and tools

Permitted reference materials and tools are subject to the employer’s determination, except where course instructions or an applicable regulatory, approval, or oversight requirement establishes a restriction.

Employer permission does not override a mandatory assessment requirement.

Learners must follow the assessment instructions and any applicable supervision requirements.

10.3 Exam retakes and course-progress resets

Learners may retake an exam as many times as necessary during the Product Key’s Access Period, subject to any applicable requirement to repeat course content before another attempt.

In certain jurisdictions or assessment arrangements, repeated unsuccessful attempts may require course progress to be reset. For example, an applicable requirement may require a Learner to repeat the course after three failed exam attempts. Any such requirement will be identified in the applicable course or assessment instructions.

Where a reset is required:

  • The Learner must repeat the required course content before attempting the exam again.
  • No additional fee is charged for repeating the course under the same Product Key.
  • The Product Key’s original expiry date remains unchanged.
  • The Learner must complete the repeated coursework and any further exam attempts before that expiry date.

An unsuccessful attempt, required reset, or repeated course does not extend the Access Period. Retaking an exam after the first valid training certificate has been achieved also does not extend that certificate’s expiry date.

10.4 Prohibited conduct

Learners and administrators must not:

  • Have another person complete a Learner’s training or exam.
  • Complete an assessment through another person’s account.
  • Obtain or distribute unauthorized answers.
  • Manipulate progress tracking or results.
  • Falsify a certificate, signature, or training record.

Technical issues affecting an assessment should be reported to customer service. A technical interruption does not establish that an assessment was passed.

11. Course Administration Hub

Depending on their permissions, Training Administrators may:

  • Invite Learners.
  • Assign purchased training.
  • View associated Learner progress and completion status.
  • Access related certificates.
  • Complete applicable certificate-signature steps.
  • Initiate supported password-reset or contact-verification communications.

Training Administrators must:

  • Act only for Learners and Organizations they are authorized to administer.
  • Protect Product Keys, Administrator Keys, and personal information.
  • Review certificate details before signing.
  • Use Learner information only for authorized training administration and related purposes.
  • Avoid representing that a Learner has completed training or demonstrated competence beyond the available evidence.

Administrative access does not authorize an administrator to use a Learner’s credentials or complete an assessment on their behalf.

12. Certificates and employer responsibilities

12.1 Automatic generation

A certificate is generated automatically when the Learner satisfies the course’s required prerequisites and completion requirements.

Where optional topics are available, completing additional material may result in an updated certificate reflecting that additional coverage.

An updated certificate does not, by itself, establish a new training or expiry date.

12.2 Required signatures

Automatic generation does not mean that all required certification steps have been completed.

Saf-T-Pak training certificates require the applicable employer signature before being treated as valid for their intended use, except where the applicable certification framework provides an alternative process, including for a self-employed person.

Where the applicable course arrangements, jurisdictional requirements, or Organization’s administration process require an exam supervisor’s signature, that signature must also be obtained, or used in place of another signature only where the applicable requirements permit.

Learners and Training Administrators are responsible for ensuring that the correct authorized person completes the required signature steps.

[LEGAL AND COURSE-APPROVAL REVIEW: Confirm the precise signature requirements for each certificate format, including UK-supervised assessments and independent Learners.]

12.3 Meaning and limitations

A certificate documents the training and completion information it states.

It must not be represented as:

  • A government-issued license.
  • Approval for every dangerous-goods activity.
  • Confirmation that a particular shipment complies with all requirements.
  • Evidence of training outside the course’s documented scope.

12.4 Employer and self-employed responsibilities

The employer or self-employed person remains responsible, as applicable, for:

  • Identifying the duties performed.
  • Determining the training required.
  • Assessing course suitability and training adequacy.
  • Providing additional job-specific, practical, workplace, or other required instruction.
  • Completing required certification and signatures.
  • Maintaining required records.
  • Monitoring recurrent training and regulatory requirements.

Saf-T-Pak does not assume those responsibilities merely by providing a course or generating a certificate.

12.5 Corrections and employment changes

Requests to correct certificate errors must use the supported process and may require verification.

Historical records must not be altered to show training that did not occur or to attribute one Learner’s completion to another person.

A former employee may request their own historical certificate or training record, subject to identity verification.

Saf-T-Pak will not replace the original employer’s details merely to represent that historical training occurred under a subsequent employer.

Nothing in this section prevents correction of a verified error or exercise of an applicable legal right.

13. Training records and account access

Account deactivation does not ordinarily delete historical training records.

After Product Key expiry, available certificate-reprinting and historical record functions may continue to be used. Continued access to records does not restore course content or assessment access.

Saf-T-Pak currently maintains training records without a fixed scheduled deletion date. This describes current practice and is not a guarantee of permanent storage or uninterrupted lifetime access.

Learners and Organizations should retain copies of records needed for their own obligations.

A confirmed training account email address cannot be changed through the ordinary account process. Losing access to that address may prevent self-service password recovery.

Contact customer service for assistance obtaining historical documents if the original account is no longer accessible. Verification may be required.

An Organization’s purchase of training does not, by itself, give it control over a Learner’s personal email account or personal Application account.

Record access, retention, correction, and disclosure remain subject to the applicable privacy notice, law, and customer agreements.

14. Exchanges, refunds, and store credit

14.1 General rule

Unused Product Keys are non-refundable. Returns solely because a key remains unused are not available.

Failure to assign or use a Product Key before expiry does not create a refund entitlement.

14.2 Exchanges and incorrect purchases

Saf-T-Pak may approve an exchange of an unused Product Key for another course or version.

For an incorrect purchase, Saf-T-Pak may approve a refund or price adjustment in conjunction with an approved exchange. This is not a general right to return an unused Product Key for a cash refund.

Exchanges require authorization. An exchange does not automatically restart or extend the original Access Period.

14.3 Exceptional store credit

In exceptional circumstances, Saf-T-Pak may authorize store credit issued as a gift card redeemable only at the Saf-T-Pak training store.

Store credit is discretionary and is not a cash refund.

Any applicable conditions will be provided when the credit is authorized.

Requests must be directed to:

customerservice@inmarklifescience.com

Nothing in this section limits a remedy or right that cannot lawfully be excluded.

15. Updates and new versions

Updates made to a purchased product during its active Access Period will be made available to customers holding an active Product Key for that product.

If a new version cannot be made available automatically under the existing Product Key, the customer may request a transfer to the new version.

A transfer provides access to the updated Training Materials. It does not automatically:

  • Extend the Product Key’s expiry date.
  • Extend the training certificate’s expiry date.
  • Establish completion of newly added material.
  • Replace any assessment required to document additional training.

Any extension must be expressly approved.

Access to updated material remains subject to the applicable course requirements and the remaining Access Period.

16. Exceptional extensions

Extensions may be considered for extreme circumstances, such as death or incapacity affecting a Learner assigned a Product Key that is no longer eligible for reassignment.

Extensions are not available merely because:

  • A Product Key remained unused.
  • Training was delayed by scheduling conflicts.
  • Employees had high workloads.
  • An Organization failed to plan training before expiry.

Requests require review and express authorization. Saf-T-Pak may request reasonable supporting information, limited to what is necessary to assess the request.

For a request involving a deceased Learner, any approved accommodation must be arranged through Saf-T-Pak and must not involve another person using the deceased Learner’s account or identity.

[CONFIRM BEFORE PUBLICATION: Whether approved extensions carry a fee and what accommodation is intended where the assigned Learner has died.]

17. Training-specific limitations

Unless expressly agreed otherwise, Saf-T-Pak does not:

  • Approve an individual shipment.
  • Classify a customer’s particular substance or payload.
  • Inspect or approve packaging prepared by a Learner.
  • Guarantee carrier acceptance.
  • Provide a legal opinion on a customer’s operations.
  • Guarantee that course completion will prevent every error, incident, enforcement action, or loss.

Examples and exercises must be applied with regard to actual shipment facts, current requirements, and applicable procedures.

Nothing in this section negates an express commitment concerning course content or a service Saf-T-Pak has agreed to provide.

18. Misuse and disputed records

Saf-T-Pak may investigate suspected key misuse, assessment misconduct, unauthorized access, or inaccurate training records.

Where reasonably necessary, we may temporarily restrict affected access or flag a disputed record during review.

Where practicable, the affected Learner or customer will have an opportunity to provide relevant information.

Corrections, invalidations, or replacements of completion records must have a documented basis. Saf-T-Pak may notify the Learner and authorized Training Administrator where appropriate and permitted by law.

General suspension, termination, and payment provisions are addressed in the Application Terms and applicable customer agreements.

19. Warranties, liability, and disputes

The applicable warranty, liability, governing-law, and dispute provisions in the Application Terms apply, subject to customer-specific agreements.

Nothing in these Training Terms excludes rights or liability that cannot lawfully be excluded.

[LEGAL REVIEW: Finalize the corresponding provisions in the Application Terms before publishing this document.]
